Surety bond for energy conservation projects – creates a uniform surety bond to secure energy or water savings
promised in a performance contract that has to be issued within 30 days of the commencement of the first day of the
first energy or waters savings guarantee year; is for a term of one year, renewable up to three years; and the penal
sum of the surety bond is equal to the annual guaranteed savings amount of energy or water savings that is measured
and calculated in accordance with the measurement and verification plan included in the contract.
School energy conservation projects – requires a school district's energy conservation project report to include
estimated costs for measurement and verification of energy savings; requires annual report to be in a form prescribed
by the Commission; reduces time period of submitting annual report; specifies that if pursuant to continuing law a
school district board of education opts not to use general bidding requirements for an installment payment contract for
energy conservation measures, the contract must be awarded through a competitive selection process in accordance
with rules adopted by the Ohio Facilities Construction Commission (OFCC)
